1.Intentional torts share three common elements as described in the text on page 113: There must be a volitional or willful act by the defendant.The person so acting must intend to bring about the consequences or appear to have intended to bring about the consequences.There must be causation. The act must be a substantial factor in bringing about the injury or consequences. Examples of intentional tort include: assault, battery, false imprisonment, conversion of property, trespass to land, and intentional infliction of emotional distress. Threatening a patient with an injection or with starting an IV line is an example of assault. Quasi intentional torts differ from intentional torts because with quasi intentional torts the intent is lacking but there is still a volitional act and direct causation. Examples of quasi intentional torts include invasion of privacy and defamation. An example of defamation is when a nurse makes false chart entries about a patient’s lifestyle or diagnoses. 2. All five RN’s that I interviewed regarding their understanding of torts were mostly confused. All five of them were asked if they could tell me the difference between intentional and quasi intentional torts. The first nurse stated that she had no clue as to what I was talking about. The second nurse said, â€Å"I think it has something to do with how nurses treat their patients.† The third nurse just looked at me in a very confused manor, as if she were waiting for me to give her more information. The fourth nurse said, â€Å"I kind of remember learning about that in nursing school, but that was many, many years ago, and I don’t recall exactly what it is. The final nurse knew a little bit more than the others and stated, â€Å"Aren’t they laws that nurses should abide by?† Although, her response was in the form of a question, at least she knew it had something to do with the law. 3. After interviewing these five nurses if became clear to me that nurses need to be reminded or re-educated often about the laws that could affect their practice. An employer providing mandatory continuing education units on torts is one good way of increasing nurses understanding of torts. Another idea could be to place posters in the elevators that nurses might use frequently. These posters should be eye-catching with graphs, diagrams and illustrations showing the differences in torts. Implementing a short video during the orientation process could be another way to increase nurses understanding of torts. Finally, with all the mobile devices that are available these days, I think it would be great if someone created an app that could be downloaded by nurses to their own personal smart phones or tablets explaining the differences between intentional and quasi intentional torts.

Cultural experience Essay

In preparation for this reflection, I began by thinking about what cultural event I would most like to attend, what would work for the assignment and what would also benefit me in my personal life by actually forcing me out of my comfort zone to experience things I never have before. Because Christianity is such a huge part of my life I immediately thought I would want to do something based on another religion since I’ve never really gone out of my religious comfort zone, but for this assignment I chose to go to a gay bar. The reason I chose to do this was because I have been raised as a Christian, I grew up in a very conservative town and while I support gay rights being around gay people is still something that is foreign and a little bit uncomfortable for me. My roommate also chose to use going to the gay bar for an assignment for her human sexuality class, so while knowing that I would have my roommate going with me made me a little bit more comfortable I still knew that t his would be something that pushed me way out of my comfort zone. We both live in Elkhart, Indiana so while we were home for spring break a gay friend of my roommates offered to take us to a club called â€Å"Metro† which is an 18 plus gay bar located in Kalamazoo, Michigan which is about 45 minutes away. Before going to the gay bar I was so nervous. As mentioned before, while I support gay rights I have not necessarily ever been exposed to them and I wasn’t sure at all what to expect. The bar that we went too isn’t strictly a gay bar so there would most likely be other straight people there but I had no idea how exactly to prepare myself for the situation. Because we were going with my roommate’s friend, who is gay, I knew I would feel a little more comfortable since we weren’t just walking in completely unprepared. I was worried what people would think of me when I went, if they would assume that I was gay. I didn’t know if it was normal for gay’s to take straight  friends with them, I was worried about how people would judge me. As I began to get ready for the night I wasn’t really too worried about what to wear, I just wore something that I would normally wear to go out but mentally I was less prepared than ever. I had no idea how I was supposed to act, what if it was awkward once I got there. Before we went my roommate and I met up with her gay friend and several of his friends. His friend group contained a mix of both gay and straight men and women who would be going to the bar with us so I immediately felt more comfortable, knowing that I wouldn’t be the only straight one other than my roommate. I expected the ride there to be awkward, considering I didn’t know anyone other than my roommate and she didn’t know anyone other than the one guy and me, but instead they were all so friendly and told us not to be nervous. Because we were going on a Saturday night they explained to us that there would probably be more gay’s there than the other nights of the week/weekend but that didn’t mean they would assume we were gay, and people were usually pretty good about asking before they hit on you. After the 45 minute drive there we finally arrived and walked in. As we walked in a realized that it wasn’t any different than any other bar would be (not that I’ve been in that many since I’m only 19) full of people, d ancing, music and drinking. The inside of the building was pretty big and there was plenty of room. Almost everybody there was dancing. The people we came with were all over 21 so they all went and got drinks while my roommate and I just hung out. It was a little overwhelming at first. There were definitely a lot of gay people around, dancing together, standing at the bar flirting, and just hanging out with groups of people. Eventually we started to loosen up a little bit, while I didn’t really talk and get to know a lot of gay people I was complimented by a lot of them. During our time there we pretty much just hung out and danced in the group that we came with. A few of the people that we came with went off and danced with other people, but because I still felt a little uncomfortable and awkward we didn’t really venture to far apart from our group and go dance with anyone else or anything. I think it would have a been a very different experience if we had gone when w e were 21 and could drink at the bar, I think it would have changed the experience a little bit. We arrived at the bar at a little bit after 10 which is when the dance floor opened and stayed until around 1 in the morning. Examine The part of this experience that was the most compelling to me was almost the sense of community that I felt was just there between the gay community. Like there were a lot of groups of people there that night that didn’t even know each other, but you would never guess that by the way they acted like they had been friends for years. Even towards me and my roommate who they didn’t know, was just some straight stranger walking in and â€Å"observing† them they were so nice and accepting. They were willing to let us into their environment, knowing that we were not a part of it and I felt no judgment or anything. My fears that I had felt earlier in the day before going were put to rest, while some people were unusually friendly to me no girls really tried to hit on me, which was really relieving. As mentioned above, the most shocking thing I noticed was the community, or the way they socialized with and accepted themselves and each other. I think that at the roots of everything its amazing how well they have a grasp on who they are, and who they want others to see them. Because being gay is looked down upon in many parts of our society that makes them part of an oppressed group. Not only are gay’s an oppressed group but I also saw varying degrees of sexism. Because the gay community also includes transgender people as well. This forced me to think past my original understanding of gender. On page 318 of the book it talks about how gender is a social construct, meaning that gender is something that society defines which was really different when you read about it and see it in person. In person seeing someone who doesn’t associate with the â€Å"gender† they are born with is something that you don’t really understand until you experience it in person. Articulate Learning By attending this event I learned a lot more about the gay community than I could ever learn from a textbook. They really are a very close knit community. Their community is a lot different than what we observe in our day to day life. In normal everyday life when we see members of the gay community on the street they are treated differently, they are looked out as outcasts and they are oppressed but seeing them in this environment gave me an entirely differently outlook on them and made me respect them a lot more. The reason this matters is because I am certain that there are other people just like me who feel uncomfortable, uneasy and unsure around people that they haven’t really been around before. Because of the way I was raised I was taught to believe being gay was wrong, so I was never really around them very often so I was unexposed and uneducated about them entirely. I think it was really good for me to experience this because it made me realize that they really aren’t that different than everyone else. The most important thing I took away from this experience was that contrary to what I personally have been taught to believe, what society has forced us to think they are not horrible awful people. They are people just like me who have been oppressed and faced many challenges to get to where they’re at now and they still don’t receive the respect and benefits that they deserve in our country. Sexuality bipolar Essay Sexuality as we know it has always been bipolar in its categories: the masculine and the feminine. People are then placed in these categories according to their anatomy, with pre-set expectations placed on them on how they would act and eventually mature. For example, it is unacceptable for women to smoke cigars, repair cars and wear moustache while men are not supposed to be doing housework, carry purses, wear nail polish and cry in public (Kunkel 283). Yet what we take for granted is our knowledge that sexuality is not bipolar and the practices that seem innocent yet oppressive, limiting and binding on our insights. For example, if one would look at a greeting card section, one will find that most of the cards are focused mainly on two categories, for mothers, sisters, aunts and grandmothers for the feminine category and fathers, grandfathers, uncles and brothers for the male. The only remotely gender neutral cards were for friends yet even they weren’t entirely neutral since their colors and design corresponds to what is viewed by society as acceptable for what males and females would like, i. e. , cards directed at women receivers tend to receive cards that are pink or pastel colored with a flowery or â€Å"cute† design. Male receivers on the other hand mostly receive blue and other masculine colors with a sporty motif. Most cards dealing with relationships depict heterosexual couples and labels such as husband and wife, girlfriend and boyfriend and such. On the other hand, depictions of homosexual couples are virtually invisible; a few cards brandishing love quotes are the only ones who are gender neutral. If a homosexual wishes to buy a card for his/her partner, his /her only option is to focus on the love section and a few of the romance. He/she would have to take care to choose the depictions on the cards as well. The reason for the invisibility of the other forms of sexuality is due to the fact that society views heterosexuality as the norm and homosexuality is deviant (Cruz 1012). Homosexuality is viewed as biologically abnormal, pathological, and anti-nature since its very principle clashes with the idea of pro-creation. Society has created labels and borders to prevent the homosexuals from being visible. One example is the categories of relationships with heterosexual anniversaries, marriages and such. In a marriage, there is a label of â€Å"husband† and â€Å"wife†, the male taking the former and the female the latter; same-sex marriages, while still being debated whether it should be legalized or not, possesses no such labels in the relationship. In contrast, the idea heteronormativity has labeled same-sex couples with derogatory names, to mark them as inappropriate behavior and be categorized as sexually deviant. (Kunkel 289). In effect, people tend to reject and persecute them, giving the deviants neither room nor niche to challenge the status quo. In one hour of television, commercials always show images of heterosexual couples in their respective niches in the crowd. Although homosexuals are portrayed in reality shows, there is no hint of their relationships with the other characters on screen. If there is a hint, it is usually downplayed and censored. Heterosexual couples however, are celebrated and objectified. There is virtually no same-sex couple that is depicted even if the media is one of the most influential driving forces in forwarding awareness of these same-sex couples. It is interesting to note that even if people are claiming that they are tolerant and accept same-sex couples, same-sex couples are still â€Å"invisible†. Heteronormativity is driven by gender roles that are imposed by society’s bipolar expectations. Its pervasiveness can be attributed to the fact that since a community is held together by unwritten laws such as norms and taboos, it is safe to assume that society is threatened by these sexually deviant individuals thus heteronormativity is more pronounced and enforced. Heterosexism, in a way, is a cord that binds our society together, yet in return it sets boundaries and insists that it is the norm. Heteronormativity itself does not empower heterosexuals and robs the power from same sex individuals; rather, it limits both parties and disempower them since they are stuck in their labels and categories, with no room to maneuver about. People believe that it is so since other forms of sexuality are invisible and are conditioned to think in the bipolar manner. Heteronormativity is everywhere since society has its own set rules and status quo that is hard to neither displace nor challenge and heteronormativity has been present ever since the formation of such communities. Even though horror and action may be the top picks of the rest of the country, I have my own genre of movies that I particularly like the best. My favorite genre of movies is romance. In a romance based movie, it is filled with love and a lot of laughter throughout the whole movie. While most romance movies start off bad and end up with a happy ending, some start out good and end good as well. Most romance movies today start out being bad and then it ends up in the happy ending that you suspect from the title of the movie. Romance movies go through every movie genre there is. There is suspense and sometimes a little horror as well. Sometimes, and most of the time, they contain a lot of drama. The best romance movies are the ones full of drama that is fun to watch. Every woman around the world enjoys a good romance movie. Many women around the world love romance movies, including myself. Civil liberties have been affected immensely by the Patriot Act.   A brief definition of the Patriot Act is; uniting and strengthening America by providing appropriate tools required to intercept and obstruct terrorism.   The Patriot Act modifies the rules on searches.   It allows third party holders of your financial, library, travel, video rental, phone, medical, church, synagogue and mosque records. These records can be searched without your knowledge or consent provided the government says it's trying to protect against terrorism.   The FBI only needs to say the search will protect against terrorism and they don't need probable cause or evidence.   A judge has no authority to reject this application.   The person doesn't have to be a terror suspect themselves as long as the government's purpose is an authorized investigation to protect against internal terrorism.   The Patriot Act also violates everyone's constitutional right to privacy.   The ACLU shows a funny b ut scary illustration of what the government can do with the information they obtain by violating the right to privacy.   Basically, the Patriot Act allows the government to monitor anyone and everyone's life whenever they choose.   While some say the Patriot Act violates civil liberties, it was designed to support the effort against terrorism. HMO Regulation Health Maintenance Organizations, or HMO’s, are a very important part of the American health care system. Also referred to as managed care programs, HMO's are combinations of doctors and insurance companies that are formed into one organization. This organization provides treatment to its members at fixed costs and decides on what treatment, if any, will be given based on the patient's or doctor's current health plan. Sometimes, no treatment is given at all. HMO's main concerns are to control costs and supposedly provide the best possible treatment to their patients. But it seems to the naked eye that instead their main goal is to get more people enrolled so that they can maintain or raise current premiums paid by consumers using their service. For HMO's, profit comes first- not patients' lives. HMO’s are groups of doctors hired by insurance companies and are usually controlled or regulated by the hospitals who facilitate them. The majority of this limitation is due to pressure from within the organization or government pressure. The government influences hospitals into denying treatment in order to cut federal costs. These government actions generally result in a revision of private employee health care claims, and in turn certain businesses can no longer afford to provide health insurance for their employees. Consequently, approximately 50 to 60 million people go without insurance for at least one month each year. Many HMO’s constantly evaluate their services to "ensure" the best care and coverage. But in many cases, what is happening is the exact opposite. HMO's can and do conduct their business quite ruthlessly. Patients are continuously unable to receive the necessary treatment due to the insufficient HMO coverage. Many HMO's actually make more money if their doctors see or treat fewer patients. According to the Associated Press, â€Å"Consumers who have been denied a treatment that the HMO says is not covered, or who inadvertently fail to follow HMO guidelines in seeking treatment and are therefore denied reimbursement, will continue to have little recourse.† (2) Many people must drive for hours, generally sick or injured, simply to receive treatment from a doctor that will be covered by their HMO. In conclusion, there still needs to be a lot of work done to health care in the United States. Other nations provide universal health care to their citizens, but this would cause dilemmas in balancing two often conflicting policy goals: providing the public with equitable access to needed pharmaceuticals while controlling the costs. Universal health care probably would not work in the U.S. because our nation is so diverse and our economy is so complex. The system we have now obviously has its problems, and there is a lot of rom for improvement. HMO’s will still create problems for people and their medical bills, but they definitely should be monitored to see that their patients are receiving just treatment.

As the history changed for the better or for the worst, there were written a lot of literature works about the heroes of a time, who had devoted their courageous deeds to people. Beowulf and Redcrosse Knight are the examples of such perfect heroes in two different periods, The Middle Age and The Early Modern Period.The story of Beowulf shows the spread of Christianity in the early Danish paganistic society that valued heroic deeds and bravery above all else. Beowulf’s heroism is shown in three separate conflicts, those with Grendel, Grendel’s mother, and the sea monster. The Faerie Queen is written during the period Christianity had been spread among people; protagonist Redcrosse knight represents a virtue of Holiness, and he is the only Christian fighting against evil. Beowulf and Redcrosse are example heroes, embodying traits typical of heroes: courage, and good deeds. The Faerie Queen,† written during the Early Modern Period, narrates a big change in Christian religious thoughts and practices. Redcrosse Knight offers his help to Gloriana, Queen of Fairyland. Una, representing truth, tells that the dragon of hell has captured her parents and that she needs help in getting them free. Redcrosse decides to get her parents released . This demonstrates a hero, he will undergo many severe trials and fight fierce monsters and this in itself is a character of a heroic knight. Not only does his armour protect his body and those who were with him, but also being a Christian.He has the protection of Christ. For the Christian in order to be holy, he must have a true faith. Much of Beowulf is devoted to expressing and demonstrating the hero, in whom strength, courage, loyalty to a nation, hospitality, gene rosity, political skill and good reputation among all people is valued. These are of great importance to such warrior societies as a way of understanding their relationships to the world and the danger waiting outside their borders. Redcrosse Knight, on the other hand, is a chivalrous hero. He must defeat villains who represent the untrue RomanChurch. The qualities of loyalty, humility, sacrifice for the good of others, and sympathy for those who are less fortunate are described in the text as well as the negative consequences from greed and pride. He meets several evildoers, the dragon from hell, the evil sorcerer Archimago, Sansfoy and Sansloy, who has no faith, the liar and representative of the Roman Church, Duessa/Fidessa, and many others. These evildoers fight Redcrosse Knight through deceit, lust, and untruth. Therefore he must be armed with faith in Christ to win the evils of the spiritual realm.As we can see, equally Beowulf and Redcrosse Knight have a vast amount of braver y. They both defeat enemies that attack or capture innocent people. They both constantly pray to Christ for help to win evil they meet and to have sympathy for those who suffer. These qualities, idealized by thanes and knighthood, such as bravery, courtesy, honour, and gallantry toward women are visible in both Beowulf and Redcrosse Knight. One difference is that women in the Old English Period are not as important as those in Middle age period. We see this in both poems. In Beowulf we only hear about Wealhtheow, Hrothgar’s queen, and Grendel’s mother.However in â€Å"The Faerie Queene,† we see many women characters, Gloriana, Una, Duessa/Fidessa, Lucifera (Hell), Caelia (Heavenly), Fidelia (Faith), Sperenza (Hope), and Charissa (Charity). In some way or another, Redcrosse and Beowulf have connections to these women, either good or bad. Additionally both heroes have a meeting with a character from hell. Beowulf dives into the lake, which is a personification of hell, where Grendel’s mother is waiting to attack. He cannot cut her with his sword, so he tosses it away and finds a larger sword killing Grendel’s mother by cutting her head off.He sees Grendel’s dead body nearby and cuts off his head as a trophy and returns to Denmark . This expresses an important virtue, loyalty. Redcrosse Knight fights Lucifera (Queen of Hell) and other evildoers. He has been weakened by his visit to the House of Pride. Although he had the instinctive good sense to flee from that castle, his conscience is still at work. This failure brings him near to death in the dungeon of Orgoglio, a giant that represents godless pride. Arthur, that represents magnificence, comes along and helps Redcrosse rise up from his lowest state.Redcrosse also defeats the dragon. Here he is compared to Christ descended to hell to win Satan. Redcrosse enters the mouth of the dragon and finally kills it by the help of The Tree of Life and The Well of Life, which are the grace of God given to mankind and which helps Christian in danger. No matter how well equipped or prepared the Christian is, he can’t win the evil without the help of God. A message is given here, a true Christian with all his humility counts on God. Another similarity of both these warriors is rewards for being heroes, however in very different ways.After Beowulf kills Grendel, he is considered the greatest hero in Danish history. Hrothgar says that Beowulf will never lack for riches, the horses and men of the Geats were all richly adorned, and a party was held to celebrate Beowulf’s victory. Redcrosse Knight, on the other hand, will receive his reward in heaven. If he continues to live sinless and fight against evildoers he will receive eternal life. The battle will not end until the end of the world, when Christ will tell which religion is false and which is true. Meanwhile, a Christian believes that honour is gained by good deeds and glory lies in afterlife.In both poems, Beowulf and Redcrosse Knight developed from heroic warriors, who have such qualities as courage, generosity, sacrifice for the good of others, into wise leaders. Beowulf rises from a fearless warrior to a reliable king and Redcrosse Knight finally becomes St. George, the patron saint of England. Both showed the necessary characteristics to become very successful nobles. Though these two outlooks are somewhat oppositional, each character acts as society dictates. Beowulf acted as a hero-warrior and Redcrosse as a chivalric-warrior. However, their Christian values are somewhat similar.The images of warrior presented in both poems are significant roles that are important to Christian life — Faith and Holiness. Thirteen years after leaving the Philippines, Crisostomo Ibarra returns as Simoun, a rich jeweler sporting a beard and blue-tinted glasses, and a confidant of the Captain-General. He cynically sides with the upper classes, encouraging them to commit abuses against the masses to encourage the latter to revolt against the oppressive Spanish colonial regime. His two reasons for instigating a revolution are at first, to rescue Marà ­a Clara from the convent and second, to get rid of ills and evils of Philippine society. His true identity is discovered by a now grown-up Basilio while visiting the grave of his mother, Sisa, as Simoun was digging near the grave site for his buried treasures. Simoun spares Basilio’s life and asks him to join in his planned revolution against the government, egging him on by bringing up the tragic misfortunes of the latter’s family. Basilio declines the offer as he still hopes that the country’s condition will improve. Basilio, at this p oint, is a graduating medical student at the Ateneo Municipal. After the death of his mother, Sisa, and the disappearance of his younger brother, Crispà ­n, Basilio heeded the advice of the dying boatman, Elà ­as, and traveled to Manila to study. Basilio was adopted by Captain Tiago after Marà ­a Clara entered the convent. Simoun, for his part, keeps in close contact with the bandit group of Kabesang Tales, a former cabeza de barangay who suffered misfortunes at the hands of the friars. He was forced to give everything he had owned to the greedy, unscrupulous Spanish friars and the Church. Before joining the bandits, Tales took Simoun’s revolver while Simoun was staying at his house for the night. As payment, Tales leaves a locket that once belonged to Marà ­a Clara. To further strengthen the revolution, Simoun has Quiroga, a Chinese man hoping to be appointed consul to the Philippines, smuggle weapons into the country using Quiroga’s bazaar as a front. Simoun wishes to attack during a stage play with all of his enemies in attendance. He, however, abruptly aborts the attack when he learns from Basilio that Marà ­a Clara had died earlier that day in the convent. A few days after the mock celebration by the stu dents, the people are agitated when disturbing posters are found displayed around the city. The authorities accuse the students present at the panciterà ­a of agitation and disturbing peace and has them arrested. Basilio, although not present at the mock celebration, is  also arrested. Captain Tiago dies after learning of the incident. But before he dies he signs a will. His will originally states that Basilio should inherit all his property but due to this forgery his property is given in parts, one to Santa Clara, one for the archbishop, one for the Pope, and one for the religious orders leaving nothing for Basilio to be inherited. Basilio is left in prison as the other students are released. Basilio is soon released with the help of Simoun. Basilio, now a changed man, and after hearing about Julà ®Ã¢â‚¬â„¢s suicide, finally joins Simoun’s revolution. Simoun then tells Basilio his plan at the wedding of Paulita Gà ³mez and Juanito, Basilio’s hunch-backed classmate. His plan was to conceal an explosive which contains nitroglycerin inside a pomegranate-st yled Kerosene lamp that Simoun will give to the newlyweds as a gift during the wedding reception. According to Simoun, the lamp will stay lighted for only 20 minutes before it flickers; if someone attempts to turn the wick, it will explode and kill everyone—important members of civil society and the Church hierarchy—inside the house. Basilio has a change of heart and attempts to warn Isagani, his friend and the former boyfriend of Paulita. Simoun leaves the reception early as planned and leaves a note behind: Initially thinking that it was simply a bad joke, Father Salvà ­ recognizes the handwriting and confirms that it was indeed Ibarra’s. As people begin to panic, the lamp flickers. Father Irene tries to turn the wick up when Isagani, due to his undying love for Paulita, bursts in the room and throws the lamp into the river, sabotaging Simoun’s plans. He escapes by diving into the river as guards chase after him. He later regrets his impulsive action because he had contradicted his own belief that he loved his nation more than Paulita and that the explosion and revolution could have fulfilled his ideals for Filipino society. Simoun, now unmasked as the perpetrator of the attempted arson and failed revolution, becomes a fugitive. Wounded and exhausted after he was shot by the pursuing Guardia Civil, he seeks shelter at the home of Father Florentino, Isagani’s uncle, and comes under the care of doctor Tiburcio de Espadaà ±a, Doà ±a Victorina’s husband, who was also hiding at the house. Simoun takes poison in order for him not to be captured alive. Before he dies, he reveals his real identity to Florentino while they exchange thoughts about the failure of his revolution and why God forsook him, when all he wanted was to avenge the people important to him that were wronged, such as Elias,  Maria Clara and his father, Don Rafael. Florentino opines that God did not forsake him and that his plans were not for the greater good but for personal gain. Simoun, finally accepting Florentino’s explanation, squeezes his hand and dies. Florentino then takes Simoun’s remaining jewels and throws them into the Pacific Ocean with the corals hoping that they would not be used by the greedy, and th at when the time came that it would be used for the greater good.
